AS OF JANUARY 01, 2018
goods/products
1.1. offers and prices
All offers are non-binding. Minimum purchases or packaging units specified by us are binding. We reserve the right to make technical and other changes within reasonable limits. b. All prices quoted apply from dispatch, excluding shipping costs, including VAT at the statutory rate.
In the case of delivery abroad, the customer bears any import fees incurred in the amount they are incurred. These are not shipping costs. i.e. We reserve the right to make price changes over which we have no influence, even after the contract has been concluded.
1.2. conclusion of contract
With the order or booking, the customer declares his contract offer binding. A confirmation of receipt on our part does not constitute a binding acceptance of the order/booking. The confirmation of receipt can be combined with the declaration of acceptance. b. We are entitled to accept the contract offer contained in the order within seven working days of receipt. We are entitled to refuse to accept the order/booking - for example after checking the customer's creditworthiness. We are entitled to limit the order to a normal household quantity. c. The conclusion of the contract is subject to the proviso that in the event of incorrect or improper delivery to ourselves, we will not pay or only pay in part. In the case of unavailability or only partial availability of the service, the customer will be informed immediately. The consideration will be refunded immediately.
1.3. delivery
Where we deliver We deliver to all European countries. Upon delivery, the goods will be invoiced and declared according to the VAT regulations established in each country. b. Partial deliveries may be possible, no additional shipping costs will be charged. Delivery times and dates specified by Thomas Wilhelm are non-binding. We assume no liability for an order processing that is not possible if the reasons for this lie with third parties. We reserve the right not to provide the promised service in the event of unavailability. c. Shipping costs Within Germany, you order free of charge from Thomas Wilhelm. In all other countries we charge a shipping fee of EUR 7.50, regardless of the value and weight of the goods. Separate arrangements are made in consultation with the customer when ordering non-household quantities. i.e. Payment Within Germany, payment is made against invoice. The customer bears the fees for international transfers. Outside of Germany, payment is made against invoice. We offer you bank accounts in Germany. The goods remain our property until full payment. e. Damage in transit Our shipments are insured against damage in transit. When returning the item, please state the reason for the return on the return receipt that you received with the delivery. G. Returns Please do not return the goods freight collect. If the value of the return is more than 40 EUR (even if you don't like it) or if the reason for the return is an error on our part (damaged item, incomplete item, wrong item or item that was not ordered), we will immediately refund your shipping costs. Please understand that goods made according to your wishes and not suitable for return are excluded from the right of withdrawal, except in the case of justified warranty claims. To meet the deadline, it is sufficient to send the package or the return request by letter, fax or e-mail in good time. A copy of the invoice must accompany the complaint. Please send all returns with the return receipts provided, including all necessary information (name, address, invoice number, account details for reimbursement of shipping costs, etc.) to the place of performance with the following address: Thomas Wilhem, Am Riedgraben 16, 74545 Michelfeld h. 1.4. privacy
Only the personal data sent to us and necessary for proper business transactions will be electronically stored, processed and used by us on the basis of the data protection regulations. The customer expressly agrees to this when placing the order. A transfer or inspection by third parties is excluded. In the future, we will inform you about our products and services by e-mail, unless otherwise specified by you. You can revoke your consent at any time either in writing or by email.
1.5. Warranty and liability
Warranty rights of the customer presuppose that he has duly fulfilled his obligations to examine and give notice of defects according to §377, §378 HGB. Complaints will only be considered if they are reported to us in writing within 14 days of receipt of the goods or, in the case of hidden defects, after their discovery. b. Insofar as there is a defect in the goods for which we are responsible, we are entitled to choose between remedying the defect or subsequent delivery. If the defect is remedied, we shall assume all expenses required for this purpose, in particular transport, travel and material costs, provided these are not increased by the fact that the goods have been taken to a place other than the place of performance. Goods that have been the subject of a complaint may only be returned with our express consent. c. If we are not willing or able to remedy the defect or make a subsequent delivery, if it is delayed beyond a reasonable period of time for reasons for which we are responsible, or if it fails in any other way, the customer is entitled to cancel the contract or reduce the purchase price to demand. i.e. Unless otherwise stated below (e) and (f), further claims of the customer are excluded. We are therefore not liable for damage that has not occurred to the delivery item itself, in particular not for loss of profit or other financial losses on the part of the customer. e. The above exemption from liability does not apply if the cause of the damage is due to intent or gross negligence or if the customer claims damages for non-performance due to the lack of a guaranteed property. f. In the event of a culpable breach of an essential contractual obligation, liability is limited to the damage that is typical for the contract and reasonably foreseeable. For the rest, it is excluded according to point (d). G. The warranty period is 6 months, calculated from the transfer of risk. This period is a statute of limitations and also applies to claims for compensation for consequential damages, insofar as no claims from tort are asserted.
1.6. transfer of risk
In the case of consumers, the risk of accidental loss and accidental deterioration of the goods sold passes to the consumer when the goods are handed over, even in the case of mail-order sales. b. In the case of entrepreneurs, the risk of accidental loss and accidental deterioration of the goods passes to the entrepreneur when the goods are handed over, in the case of mail-order sales when the goods are delivered to the freight forwarder, the carrier or the person or institution otherwise responsible for carrying out the shipment. c. When downloading and sending data via the Internet, the risk of loss and alteration of the data passes to the customer when the network interface is crossed.
1.7. retention of title
Goods delivered by us remain our property until all liabilities of the customer from the delivery contract concluded with us have been completely fulfilled. If the customer behaves in breach of contract, in particular in the event of default in payment, we are entitled to take back the goods we have delivered. Taking back or pledging the goods does not justify withdrawal from the contract.
